Trump Administration Will Miss Deadline to Reunite All Migrant Children Under 5

Two weeks ago, U.S. District Judge Dana Sabraw in San Diego issued an order to the Trump Administration to reunite the thousands of immigrant children separated from their parents.

Federal officials said in court records filed Tuesday that 38 of the 102 children under age 5 separated from their parents at the U.S. -Mexico will have been reunited by Tuesday's deadline. Today's secretive reunification operation will be overseen by the Department of Homeland Security and will involve transporting the children hundreds of miles across the country to undisclosed locations.

Lee Gelernt, deputy director of the ACLU's Immigrants' Rights Project and the lead lawyer who argued for the preliminary injunction, said in a July 8 press release that the request for more time was unacceptable given the levels of trauma the children have already been subjected to.

Speaking outside the White House before flying to Europe, Trump said: "Well, I have a solution".

The judge acknowledged that more time may be justified only in specific cases, but initially left the Tuesday deadline intact for children under age 5, along with a July 26 deadline to reunite all children age 5 and above with their parents.

On Tuesday, with the court-mandated deadline looming, the government responded.

At a court hearing, Justice Department lawyer Sarah Fabian acknowledged the government wouldn't meet the deadline for all the children, citing a variety of reasons, including that the parents of some of the youngsters have already been deported.

About 40 other very young children will not be returned to their parents yet, despite a court-imposed deadline, because the Trump administration either has not finished matching them with their parents or has not cleared the parents to take custody.
