Court orders restoration of DACA program

Under the judge's order, the government is required to continue processing DACA renewal requests for people who already are enrolled in the program and those whose enrollment lapsed before September 5, 2017.

Judge Nicholas Garaufis, a former President Bill Clinton appointee on the U.S. District Court for the Eastern District of NY, concluded the government violated the Administrative Procedure Act (APA) when it ended the program.

President Donald Trump's move to end a program protecting hundreds of thousands of children of undocumented immigrants from deportation was blocked by a federal judge in NY.

"Today's court ruling out of the district court in Brooklyn shows that courts from coast to coast have sent a single clear message to President Trump: The way that he terminated DACA was not just immoral, it was unlawful", said Karen Tumlin, legal director at the National Immigration Law Center. He declined to extend the programme for new applicants.

Under Tuesday's ruling, the government must accept renewal applications only from people previously approved for the Deferred Action for Childhood Arrivals program, not from people who were eligible but never applied.

"Defendants indisputably can end the DACA program", the judge wrote in Tuesday's opinion. "The court concludes that defendants have not done so". The government has even asked for the Supreme Court to take the case, skipping over the 9th U.S. Circuit Court of Appeals.

Mr. Trump had set a March 5 phaseout data for the DACA program.

The legal battle over DACA complicates a debate now underway in Congress on whether to change the nation's immigration laws.

In revoking DACA a year ago, Attorney General Jeff Sessions and acting Homeland Security Secretary Elaine Duke said they were facing the threat of a lawsuit and doubted they could legally defend the program. He said that the courts will vindicate the administration's position that it acted properly in ending the program.

The Coalition for Humane Immigrant Rights of Los Angeles (CHIRLA) has been running sign-up drives several times a week since Judge Alsup's first ruling, and said people have lined up for help to renew their permits.
